01 · Using Art Ki Haveli

The agreement that applies when you browse, enquire or purchase.

SECTION 01

Acceptance of These Terms

These Terms & Conditions govern your access to and use of the Art Ki Haveli website, including browsing, creating an account, submitting an enquiry, purchasing ready-made artwork, ordering prints or placing a custom portrait or commission.

By using the website, submitting an order or approving a quotation, you agree to these terms together with the product description, quotation, Privacy Policy, Shipping Policy and Return & Refund Policy that apply to your transaction. If you do not agree, please do not place an order.

SECTION 02

Who You Are Contracting With

“Art Ki Haveli”, “we”, “us” and “our” refer to the seller identified in the Business & Grievance Details panel on this page. “You” and “customer” refer to the person using the website or placing an order.

Before publishing this page, replace every bracketed placeholder with your correct legal/business details. The order confirmation or invoice may contain additional seller information that forms part of the transaction.

SECTION 03

Eligibility and Legal Capacity

You must be at least 18 years old and legally capable of entering into a binding contract to place an order. A parent or lawful guardian must place and supervise an order made for a minor.

You may purchase for personal use or for a disclosed business purpose. You must not use the website or products for an unlawful, fraudulent or prohibited purpose.

SECTION 04

Accounts and Accurate Information

Where account registration is available, you are responsible for keeping your login credentials confidential and for activities performed through your account. Notify us promptly if you suspect unauthorised use.

You agree to provide complete and accurate name, contact, billing, delivery and customisation information. Delays, extra costs or failed delivery caused by incorrect information may be charged to you where permitted by law.

02 · Products, Prices & Orders

How listings, availability, pricing and order acceptance work.

SECTION 05

Product Information

We make reasonable efforts to describe each artwork, print, frame, material, size, colour, finish, preparation time and included accessory accurately. Product images may include styling props that are not included unless expressly stated.

Dimensions are approximate unless stated as exact. Please read the complete product description and contact us before ordering if a particular colour, size, texture, frame or delivery date is essential.

SECTION 06

Handmade Character and Colour Variations

Original and handmade products may show small variations in brushwork, texture, grain, edge finishing, pattern, placement, shade or dimensions. These are natural characteristics of handmade work and are not normally defects.

Screen calibration, lighting and photography can affect the appearance of colour. We cannot guarantee that the colour shown on every device will exactly match the physical artwork.

SECTION 07

Availability, Pricing, Taxes and Errors

Prices are shown in the currency displayed on the website. Applicable taxes, packaging, shipping, cash-on-delivery charges or customisation fees will be shown at checkout or in the final quotation.

Products and prices may change before an order is accepted. If an obvious listing, availability or pricing error is discovered, we may contact you to confirm a corrected order or cancel it and refund the amount received through the original payment method.

SECTION 08

Placing and Accepting an Order

Adding an item to the cart or completing checkout does not reserve stock or create final acceptance. Your order is accepted when payment is successfully received and we send an acceptance, processing or dispatch confirmation, or when we otherwise confirm the custom commission in writing.

We may refuse or cancel an order before fulfilment where the item is unavailable, payment fails, information is incomplete, fraud is suspected, delivery is not reasonably available, the request is unlawful or unsafe, or the custom brief cannot be completed to an acceptable standard.

SECTION 09

Payment and Verification

Payments are processed through the methods displayed at checkout. You confirm that you are authorised to use the selected payment method and that the payment information is accurate.

Banks and payment gateways may conduct verification or place a temporary hold. We do not store complete card details when payment is handled by an independent payment provider. Work or dispatch may be paused until payment is confirmed.

SECTION 10

Coupons, Offers and Gift Benefits

Promotional codes are subject to the stated validity period, eligibility, minimum order value and product exclusions. Unless stated otherwise, only one code may be used per order and codes cannot be exchanged for cash.

We may cancel a promotion or reject misuse, automated use, duplicate claims, resale or fraud. A refund for a discounted order will not exceed the amount actually paid for the returned item.

03 · Custom Portraits & Commissions

The complete process for made-to-order artwork.

SECTION 11

Custom Order Brief and Quotation

A custom order begins only after we review the subject, reference images, size, medium, style, background, framing, inscription, delivery location and requested date. A requested date is not guaranteed until we confirm it in writing.

The final quotation may include design, materials, framing, packaging, shipping, urgency and revision charges. Any detail not included in the written brief is not automatically included in the order.

SECTION 12

Reference Photos and Permissions

You must provide clear and lawful reference material and confirm that you own it or have permission to use it for the commission. For portraits of another person, you are responsible for obtaining any consent reasonably required.

We may refuse material that is illegal, abusive, hateful, sexually exploitative, privacy-infringing, misleading, defamatory or likely to violate another person’s rights.

SECTION 13

Deposit, Work Commencement and Cancellation

A custom commission may require full payment or a non-refundable booking deposit before work begins. The quotation should state the payment schedule and the stage at which materials are purchased or work commences.

Before work begins, cancellation may be accepted subject to any disclosed administrative or payment costs. After materials are purchased or work has started, the deposit or a reasonable amount representing work already completed and costs incurred may be non-refundable, subject to applicable law.

SECTION 14

Proofs, Revisions and Approval

Where a sketch, digital mock-up or progress image is offered, you must review it carefully and respond within the stated time. Delayed feedback may move the completion and delivery date.

The quotation should state the number and scope of included revisions. Changes to the original brief, replacement reference images, major composition changes or extra revision rounds may require additional payment and time. Approval of a stage authorises us to continue from that stage.

SECTION 15

Creative Interpretation and Likeness

Handmade art involves the artist’s interpretation. We will use reasonable skill and care to follow the accepted brief, but an artwork is not a mechanical reproduction and cannot be guaranteed to match a photograph pixel-for-pixel.

Differences caused by the selected medium, artistic style, canvas size, reference quality or hand-rendered process are not normally defects when the completed work is materially consistent with the approved brief.

SECTION 16

Production Time, Drying and Urgent Orders

Production estimates begin after the brief, usable references and required payment are received. Drying, varnishing, framing, curing and safe packaging time may be necessary after the artwork itself is complete.

Urgent requests are accepted only when confirmed in writing and may carry an additional charge. We are not responsible for a missed occasion where the requested date was not expressly accepted as a guaranteed commitment.

04 · Shipping & Delivery

Preparation, courier, address and delivery responsibilities.

SECTION 17

Shipping Areas, Charges and Estimates

Available delivery locations, shipping charges and estimated transit times are shown at checkout or communicated before acceptance. Some oversized, fragile, framed or remote-area deliveries may require a separate quote.

Preparation and delivery dates are estimates unless expressly confirmed as guaranteed. Courier operations, weather, public holidays, security restrictions, remote locations and events outside reasonable control may cause delay.

SECTION 18

Address, Failed Delivery and Re-shipping

You must provide a complete deliverable address, correct postal code and reachable phone number. Review these details before payment and contact us immediately if a correction is required.

Additional courier, return-to-origin, storage or re-shipping costs caused by an incorrect address, refusal, repeated failed delivery or an unclaimed parcel may be payable by the customer where permitted by law.

SECTION 19

Risk, Ownership and Inspection

Ownership of a physical product transfers after full payment. Risk of loss or damage transfers in accordance with applicable law and the delivery arrangement used.

Inspect the parcel promptly. Do not discard the outer box, protective materials, labels or invoice until you have checked the artwork. A clear unboxing video is strongly recommended for fragile or high-value orders.

SECTION 20

International Orders, Customs and Import Charges

International delivery may be available only by prior confirmation. The customer is responsible for providing any information reasonably required by the courier or customs authority.

Import duties, local taxes, brokerage charges, customs delays or destination restrictions are generally the customer’s responsibility unless the quotation expressly states otherwise. We cannot mark an order with a false value or description.

SECTION 21

Delivery Delay and Lost Parcels

If tracking does not update or a parcel is delayed, contact us so that we can raise an enquiry with the courier. Courier investigations can take time and a replacement or refund may be considered after the required verification.

We are not responsible for delay caused by events outside reasonable control, but we will take reasonable steps to communicate and assist with the available remedy.

05 · Cancellations, Returns & Refunds

Clear rules for ready-made and personalised orders.

SECTION 22

Cancellation of Ready-Made Orders

A cancellation request should be sent as soon as possible. A ready-made order may usually be cancelled before packing or dispatch. After dispatch, the request will be handled under the applicable return policy.

Non-recoverable payment, packaging or courier charges may be deducted only where lawful and previously disclosed.

SECTION 23

Returns for Eligible Ready-Made Products

Return eligibility, time limit and exclusions are set out in the Return & Refund Policy. Unless a different period is stated, replace this sentence with your rule: [Return request must be made within X days of delivery.]

An eligible item should be unused, unaltered and returned with the original certificate, accessories and protective packaging. The customer may be responsible for safe return shipping for a change-of-mind return, subject to applicable law.

SECTION 24

Personalised and Custom-Made Products

Because personalised and made-to-order products are created for a specific customer, they may not be returnable or refundable for change of mind once work has begun, except where required by law or where the item is damaged, defective or materially different from the confirmed brief.

A minor handmade variation, reasonable artistic interpretation or screen-to-physical colour difference is not by itself a basis for a refund.

SECTION 25

Damaged, Defective or Incorrect Orders

Contact us promptly after delivery and provide the order number, a description of the problem, clear photographs of the artwork, outer and inner packaging, shipping label and, where available, an unboxing video. Replace this sentence with your reporting period: [Report transit damage within X hours/days.]

After verification, the available remedy may include repair, replacement, partial refund, store credit or full refund, depending on the issue, stock, courier claim and applicable law. Keep all packaging until the claim is resolved.

SECTION 26

Refund Method and Processing Time

Approved refunds are normally sent to the original payment method. The amount may exclude non-refundable costs only where lawful and clearly disclosed.

Replace this sentence with your actual timeframe: [We initiate approved refunds within X business days; banks and payment providers may take additional time to display the credit.]

06 · Content, Copyright & Website Use

Who owns artwork, images and website content.

SECTION 28

Licence to Use Customer-Supplied Content

You retain ownership of reference images and other content you submit. You grant us a limited, non-exclusive permission to use that content only as reasonably necessary to assess the request, create the commissioned artwork, fulfil the order, provide support and maintain lawful transaction records.

This permission does not automatically allow us to publish a private portrait for marketing. Any promotional use should be based on separate permission, an agreed portfolio clause or content that you have made public and clearly invited us to reshare.

SECTION 29

Reviews, Tags and Testimonials

When you submit a review, public comment, testimonial or tagged social-media post, you confirm that it is truthful, lawful and does not infringe another person’s rights.

Where you expressly allow us to feature it, you grant us permission to display that content with reasonable edits for size, spelling or formatting. You may request removal of future promotional use, subject to material already printed or lawfully archived.

SECTION 30

Prohibited Website Use

You must not damage or overload the website, bypass security, introduce malware, automate abusive requests, scrape content at scale, impersonate another person, place fraudulent orders, misuse promotions, interfere with payment systems or attempt unauthorised access.

We may block access, cancel suspicious orders, preserve evidence or report conduct where fraud, infringement, security risk or unlawful activity is reasonably suspected.

SECTION 31

Third-Party Services and Links

The website may use independent payment gateways, hosting, analytics, messaging, social-media, courier and other service providers. Their services may be subject to their own terms and privacy practices.

An external link is provided for convenience and does not mean that we control or endorse every statement, product or practice on the external site.

07 · Privacy, Liability & Legal Terms

Important legal protections and consumer safeguards.

SECTION 32

Privacy, Cookies and Personal Data

Personal data is handled in accordance with our Privacy Policy for purposes such as responding to enquiries, processing payment, producing custom work, arranging delivery, preventing fraud, keeping records and providing support.

Provide only information necessary for the order. Where consent is the basis of processing, you may withdraw it, but this will not invalidate earlier lawful processing and may prevent us from continuing a service that requires the information.

SECTION 33

Website Availability and Corrections

We aim to keep the website accurate and available, but temporary downtime, technical faults, outdated stock information or typographical errors may occur. We may correct content, update features or suspend access for maintenance or security.

We do not guarantee that every product will remain available until an order is accepted.

SECTION 34

Warranties and Disclaimers

We will perform accepted services with reasonable skill and care and provide products materially consistent with the confirmed description, subject to the handmade characteristics explained in these terms.

Except for rights and warranties that cannot legally be excluded, the website and general informational content are provided without additional implied guarantees. Nothing in these terms excludes a mandatory statutory right.

SECTION 35

Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss, loss of profit, loss caused by unauthorised customer instructions, or loss arising from misuse of an artwork or website content.

Any liability that cannot lawfully be excluded remains limited only to the extent allowed by applicable law. Nothing excludes liability for fraud, wilful misconduct or any liability that the law does not permit us to exclude.

SECTION 36

Your Responsibility for Claims

You are responsible for losses or third-party claims resulting from reference material you had no right to use, unlawful instructions, fraudulent payment, prohibited website activity or your material breach of these terms.

This clause applies only to the extent permitted by law and does not make you responsible for loss caused by our own breach or negligence.

SECTION 37

Events Outside Reasonable Control

Neither party is responsible for delay or failure caused by events outside reasonable control, such as natural disaster, fire, flood, epidemic, war, civil disturbance, transport disruption, government restriction, internet outage, courier shutdown, material shortage or power failure.

The affected party should take reasonable steps to reduce the impact. If performance becomes impossible or excessively delayed, we may agree a revised timeline, substitute remedy or lawful cancellation and refund.

SECTION 38

Suspension and Termination

We may suspend an account, website access or unfulfilled order where required for security, suspected fraud, abusive conduct, non-payment, unlawful instructions or a serious breach of these terms.

Termination does not affect rights or obligations that arose earlier, including payment due, refund rights, copyright, confidentiality and dispute provisions.

SECTION 39

Changes to These Terms

We may update these terms to reflect changes in the business, website, services or law. The revision date appears at the top. The version generally applying to an order is the version available when the order is placed, unless a change is required by law or separately agreed.

Updated terms apply to future use and future orders. We will not retrospectively remove mandatory consumer rights.

SECTION 41

Governing Law, Complaints and Disputes

These terms are governed by the laws applicable in India. Nothing in this clause prevents a consumer from using a forum, remedy or protection that cannot lawfully be excluded.

Please first send a written complaint with your order number and requested resolution. We will make a reasonable effort to resolve it through customer support and the grievance process. Unresolved disputes may be submitted to a court, consumer commission or other competent forum under applicable law.

SECTION 42

Contact and Grievance Redressal

For an order, legal notice, privacy request or grievance, use the contact details shown in the Business & Grievance Details panel. Include your order number, contact information, a clear description and supporting evidence.

Replace the placeholders with the designated grievance contact and publish realistic response timelines. Keep complaint records and respond in accordance with the laws and rules applicable to your business.

FINAL PUBLISHING CHECK

Make the policy match the real customer experience

Confirm your return window, damage evidence, production time, refund processing, contact details and grievance process before publishing.

CUSTOM ARTWORK REMINDER

A custom delivery date is confirmed only after review

Reference quality, artwork size, medium, revision requirements, drying or framing time, workload and destination can affect the final timeline.
